Agreement to Terms
By using Mercy, you agree to these Terms of Service. If you disagree with any part, please don't use our services. These terms apply to the Mercy mobile application and all related services.
Medical Disclaimer
Important Health Notice
Mercy provides informational skincare analysis based on ingredient data and user profiles. It is NOT a substitute for professional medical advice, diagnosis, or treatment. Always consult with a qualified dermatologist or healthcare provider for skin conditions, allergies, or medical concerns.
- Mercy's verdicts are algorithmic recommendations, not medical prescriptions
- Individual reactions to products can vary significantly
- For serious skin conditions, seek professional medical care
- Always patch test new products regardless of verdict
- Stop use immediately if irritation occurs
Use License
We grant you a limited, non-exclusive, non-transferable license to:
- Access and use Mercy for personal, non-commercial purposes
- Create one account per person
- Save and export your skincare data for personal use
Prohibited Uses
You agree NOT to:
- Use Mercy for commercial purposes without written consent
- Reverse engineer, copy, or redistribute our algorithms
- Scrape or harvest data from the service
- Create multiple accounts or share account credentials
- Upload false, misleading, or harmful content
- Interfere with service operation or security
- Violate any applicable laws or regulations
Account Responsibilities
- You're responsible for maintaining account security
- Provide accurate, current information
- Notify us immediately of unauthorized access
- You're liable for all activity under your account
- We may suspend accounts violating these terms
Subscription & Payments
Billing:
- Subscriptions auto-renew unless canceled
- Prices may change with 30 days notice
- Payments processed through App Store
- All applicable taxes are additional
Cancellation:
- Cancel anytime through App Store settings
- No refunds for partial billing periods
- Access continues until end of current period
Intellectual Property
Mercy and its original content, features, and functionality are owned by Mercy, Inc. and protected by international copyright, trademark, and other intellectual property laws.
- The Mercy name, logo, and verdicts system are our trademarks
- You retain rights to your user-generated content
- You grant us license to use your content for service operation
- Third-party brands and products are their respective owners' property
Disclaimers & Limitations
Service provided "AS IS":
- No warranty of accuracy or completeness
- Results may vary by individual
- We don't guarantee specific outcomes
- Service availability not guaranteed
Limitation of Liability:
To the maximum extent permitted by law, Mercy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data, or goodwill, arising from your use of the service.
Indemnification
You agree to defend, indemnify, and hold harmless Mercy and its affiliates from any claims, damages, or expenses arising from your use of the service or violation of these terms.
Privacy
Your use of Mercy is also governed by our Privacy Policy. Please review it to understand our data practices.
Changes to Terms
We may revise these terms at any time. Material changes will be notified via email or in-app. Continued use after changes constitutes acceptance of new terms.
Termination
We may terminate or suspend your account immediately, without prior notice, for conduct violating these terms or harming other users, us, or third parties.
User Content and Conduct
Content Guidelines:
By submitting content to Mercy, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such content for service operation and improvement.
- You retain ownership of your content
- Content must be accurate and not misleading
- No content that violates others' intellectual property
- No harmful, offensive, or illegal content
- We may remove content that violates these guidelines
Community Standards:
- Respect other users and their privacy
- No harassment, bullying, or discrimination
- No spam or commercial solicitation
- No impersonation of others
- Report violations to support@mercyskin.app
DMCA Compliance
Mercy respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe your copyrighted work has been infringed:
- Provide identification of the copyrighted work
- Identify the allegedly infringing material
- Include your contact information
- Include a statement of good faith belief
- Include a statement of accuracy under penalty of perjury
- Provide your physical or electronic signature

Dispute Resolution
Arbitration Agreement:
Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association's Consumer Arbitration Rules.
- Arbitration shall be conducted in San Francisco, California
- Each party bears their own costs unless otherwise awarded
- Class action waiver: disputes must be brought individually
- Small claims court exception for qualifying disputes
- 30-day notice requirement before initiating arbitration
Opt-Out Provision:
You may opt out of arbitration by sending written notice within 30 days of first accepting these terms to: legal@mercyskin.app
Age Restrictions
Mercy is intended for users who are at least 13 years old. Users under 18 require parental consent.
- Users 13-17 must have parental permission
- We do not knowingly collect data from users under 13
- Parents may request deletion of minor's data
- Age verification may be required for certain features
- COPPA compliance for U.S. users
Export Controls and Sanctions
You may not use Mercy in violation of U.S. export laws, sanctions, or embargoes. By using our service, you represent that you are not located in a country subject to U.S. embargo or designated as a terrorist-supporting country, and you are not on any U.S. prohibited parties list.
Third-Party Links and Services
Mercy may contain links to third-party websites or services. We are not responsible for:
- Content or practices of third-party sites
- Products or services offered by third parties
- Privacy policies of linked websites
- Accuracy of third-party information
- Transactions conducted with third parties
Force Majeure
Mercy shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
Governing Law and Jurisdiction
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Subject to the arbitration provisions above, exclusive jurisdiction for any disputes shall be in the state and federal courts located in San Francisco County, California.
For users outside the United States, local laws may apply to certain aspects of these Terms. You are responsible for compliance with applicable local laws.
Entire Agreement
These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and Mercy regarding the use of our service, superseding any prior agreements or understandings.
Severability
If any provision is deemed invalid or unenforceable, the remaining provisions continue in full force.
